DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) POLICY

1. DMCA POLICY
File2 is operated by Respire (GitHub: @RimunAce), an individual operator in Malaysia ("I," "me," "my"). I respect the intellectual property rights of others and expect users of the service to do the same. I have adopted and implemented this DMCA Policy to address claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).
Individual Operator Limitations: As an individual operator with limited resources, I process DMCA requests within available capacity. This service has no business insurance or corporate legal department - all requests are handled personally with simple, direct resolution preferred.
2. COPYRIGHT INFRINGEMENT NOTIFICATION
If you believe that your work has been copied in a way that constitutes copyright infringement and is accessible through the Service, you may notify me as the Copyright Agent, as described below.
Commercial Use Violations: Files uploaded for commercial purposes without permission (as prohibited in the Terms of Service) may also constitute copyright infringement and will be processed under this DMCA policy with immediate removal.
DMCA Notification Requirements
To be effective, a copyright infringement notification must include the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit me to locate the material
- Information reasonably sufficient to permit me to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

Response Time: DMCA notices will be processed within 5-14 business days depending on availability and complexity. As an individual operator, I prioritize clear, well-documented requests with sufficient evidence.
Only DMCA notices should go to the Copyright Agent. Any other feedback, comments, requests for technical support, and other communications should be directed to the general contact email.
4. PROCEDURE UPON RECEIPT OF COPYRIGHT INFRINGEMENT NOTIFICATION
Upon receipt of a valid DMCA notification, I will:
- Review the request within 5-14 business days
- Remove or disable access to the infringing material if valid
- Notify the user who posted the material that I have removed or disabled access to the material (if applicable)
- Provide the user with a copy of the DMCA notification
- Block repeat offenders' IP addresses if necessary
Simple Resolution: I prefer direct, clear communication. Provide specific file URLs, clear ownership evidence, and reasonable requests for the fastest resolution.
5. COUNTER-NOTIFICATION PROCEDURE
If you believe your material was removed or disabled as a result of mistake or misidentification, you may file a counter-notification with me as the Copyright Agent.
Counter-Notification Requirements
To be effective, a counter-notification must include the following information:
- Your physical or electronic signature
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Malaysian courts or courts in your local jurisdiction, and that you will accept service of process from the person who provided notification or an agent of such person
Upon receipt of a valid counter-notification, I will forward it to the party that submitted the original DMCA notification. If I do not receive notice that legal action has been initiated seeking a court order to restrain the user from engaging in infringing activity relating to the material, I may replace the removed material or cease disabling access to it within 5-14 business days, depending on availability.
6. REPEAT INFRINGER POLICY
In accordance with the DMCA and other applicable law, I have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. I may also, in my sole discretion, limit access to this Service and/or terminate accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Enhanced Enforcement: Repeat offenders will face:
- Immediate account termination
- IP address blocking for severe or repeated violations
- Permanent ban from the Service
- Cooperation with law enforcement if required
Commercial Use Violations: Users found uploading copyrighted content for commercial purposes without permission will be treated as repeat infringers regardless of the number of violations.
7. ACCOMMODATION OF STANDARD TECHNICAL MEASURES
I accommodate and do not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, within the limitations of individual operator resources.
8. LIMITATIONS AND DISCLAIMERS
Individual Operator Limitations: As an individual operator without corporate legal resources:
- I cannot provide legal advice or interpretation of copyright law
- Response times depend on personal availability (5-14 business days)
- Complex legal disputes may require simplified resolution or referral to appropriate authorities
- I have limited liability and no business insurance coverage
Force Majeure: DMCA response times may be delayed due to personal emergencies, technical failures, natural disasters, or other events beyond my control.
Governing Law: This DMCA policy is governed by Malaysian law, though I will cooperate with valid international copyright enforcement within my capabilities.
