1. ACCEPTANCE OF TERMS

Welcome to File2. This service is operated by Respire (GitHub: @RimunAce), an individual operator in Malaysia ("I," "me," "my"). By accessing or using this file upload service (the "Service"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use the Service.

Age Requirement: You must be at least 13 years of age to use this Service. If you are under 18, you represent that you have parental consent to use this Service.

2. DESCRIPTION OF SERVICE

File2 provides a free, donation-supported media sharing platform that allows users to upload and share files with unique identifiers. The service supports both permanent and temporary file storage with automatic expiration. This service is designed for personal, non-commercial uploading, storage, and sharing of digital media files.

Service Limitations: As an individual operator with limited resources, the Service has capacity constraints and no uptime guarantees. Service availability depends on third-party infrastructure and may be interrupted or discontinued at any time.

3. COMMERCIAL USE PROHIBITION

STRICTLY PROHIBITED: Any commercial use of File2 without my express written permission is forbidden. This includes but is not limited to:

• Business file sharing or hosting
• E-commerce product images
• Revenue-generating content distribution
• Corporate or organizational use for profit

Files found to be used for commercial purposes will be deleted and accounts terminated immediately. Violators may be liable for damages and legal costs.

4. USER RESPONSIBILITIES AND CONDUCT

By using this Service, you agree to:

• Comply with all applicable laws and regulations in your jurisdiction
• Not upload any content that is illegal, harmful, or infringes on others' rights
• Not use the Service for any unlawful purpose or cybercrime
• Not attempt to interfere with, exploit, or attack the Service or its infrastructure
• Not upload content that contains viruses, malware, or other harmful components
• Not engage in spam, DDoS attacks, or abuse of system resources
• Not attempt bulk or automated uploads without permission
• Maintain backups of your own content - I am not responsible for data preservation

5. PROHIBITED CONTENT

You may not upload content that:

• Is illegal or promotes illegal activities in any jurisdiction
• Infringes on intellectual property rights or violates copyright
• Contains personal information of others without consent
• Violates privacy rights or constitutes doxxing
• Is threatening, harassing, defamatory, or promotes violence
• Is discriminatory based on race, gender, religion, or other protected characteristics
• Contains false information, promotes scams, or constitutes fraud
• Violates any third-party rights or terms of service
• Constitutes cyberbullying, stalking, or harassment
• Contains malicious code, exploits, or security vulnerabilities

Additional file types and content categories may be prohibited at my discretion and will be removed without notice.

6. CONTENT RIGHTS AND MONITORING

You retain ownership of your content, but grant me the following rights:

• Non-exclusive, royalty-free license to store, display, and distribute your content for Service operation
• Right to scan, analyze, and moderate content for security and compliance purposes
• Right to remove duplicate files (deduplication) to conserve storage space
• Right to delete content that violates these Terms or applicable laws
• Right to cooperate with law enforcement and provide content when legally required

No Content Review Guarantee: I do not actively monitor uploaded content but reserve the right to review, scan, and remove content at any time. You are solely responsible for your uploads.

7. USER INDEMNIFICATION

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS Respire, the Service, and any associated parties from any claims, damages, losses, costs, or legal fees arising from:

• Your use of the Service or uploaded content
• Your violation of these Terms or applicable laws
• Your infringement of third-party rights
• Any commercial use of the Service without permission
• Any illegal, harmful, or prohibited content you upload

8. SERVICE MODIFICATIONS AND TERMINATION

I reserve the right to:

• Modify, suspend, or discontinue the Service at any time without notice
• Change these Terms at any time - continued use constitutes acceptance
• Terminate accounts immediately for Terms violations
• Block IP addresses for abuse, attacks, or repeat violations
• Remove content without notice for any reason

9. ENFORCEMENT AND ABUSE REPORTING

Response Time: Abuse reports will be addressed within 5-14 business days, depending on availability and severity.

Violations: Accounts violating these Terms will face immediate suspension. Repeat offenders will be permanently banned. Serious violations may result in IP blacklisting and reporting to authorities.

Simple Resolution: I prefer simple, direct resolution of disputes. Contact me with clear evidence for content removal requests or Terms violations.

10. DISCLAIMERS AND LIMITATIONS OF LIABILITY

"AS IS" SERVICE: The Service is provided "as is" and "as available" by an individual operator with limited resources. I EXPRESSLY DISCLAIM ALL WARRANTIES of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

NO GUARANTEES: I do not guarantee that the Service will be:

• Uninterrupted, timely, secure, or error-free
• Free from data loss or corruption
• Available at any specific uptime percentage
• Compatible with all devices or browsers
• Free from security vulnerabilities

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, I SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DATA LOSS, REVENUE LOSS, OR BUSINESS INTERRUPTION, REGARDLESS OF THE THEORY OF LIABILITY.

Individual Operator Limitations: As an individual without business insurance or significant financial resources, my total liability is limited to the amount paid by you for the Service (which is $0 for free users).

11. FORCE MAJEURE

I shall not be liable for any failure or delay in performance due to events beyond my reasonable control, including but not limited to:

• Natural disasters, acts of God, or extreme weather
• Government actions, regulations, or legal requirements
• Third-party service failures (hosting, storage, internet providers)
• Cyber attacks, DDoS attacks, or security breaches
• Hardware failures, power outages, or infrastructure problems
• Personal emergencies or health issues

12. DISPUTE RESOLUTION

Informal Resolution: Before pursuing any legal action, you agree to contact me directly to attempt informal resolution of disputes.

Governing Law: These Terms are governed by the laws of Malaysia. Any disputes shall be resolved in Malaysian courts, but I prefer simple, out-of-court resolution when possible.

No Class Actions: You agree not to participate in class action lawsuits against the Service.

13. DONATIONS AND SUPPORT

File2 operates on voluntary donations through GitHub Sponsors and Ko-Fi. Donations are voluntary and do not create any contractual obligations for enhanced service, support, or guarantees.

14. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full effect. These Terms constitute the entire agreement between you and me regarding the Service and supersede all prior agreements.

My failure to enforce any right or provision shall not constitute a waiver of such right or provision.
